Absolute Aviation will be operating a flight from:
London, Stansted to Johannesburg, OR Tambo
Target Timing: Week commencing 18 May 2020, subject to flight approval timing
Cut-off date for registration of these flights: 6 May 2020 at 12pm (GMT)
The flight is an unscheduled, mission specific and entirely bespoke charter operation and as such requires a minimum passenger count of 150 pax (combined passenger count for both in the outbound and inbound flights) to be viable. As such, Absolute Flight Services proposes to close passenger applications at 12h00 UK time on Wednesday the 6th May, 2020. At that time, it will be determined whether there is sufficient demand to make the flight commercially viable and costs will be fixed and announced according to the passenger numbers.
The pricing per passenger is entirely determined by passenger numbers and reduces as the passenger numbers increase. Passenger capacity on the flight is 150 pax in either direction.
Passenger payment will only be required when the passenger has been cleared to fly by Absolute Flight Services with the regulating authority. Payment must be made in full by electronic transfer within 24 hours of digital notification of this approval. Failure to send a related proof of payment within these terms will result in automatic passenger removal and Absolute Flight Services reserve the right to replace such passengers without prior notification.
Reimbursement of passenger funds will be made in full if Absolute Flight Services are required to cancel the flight due to negligence or technical failure. No reimbursement will be due in the event of any passenger related cancellation / failure to meet flight requirements for any reason whatsoever within 48 hours of the expected flight departure.

TERMS AND CONDITIONS
Any passenger found to be traveling on invalid or fraudulent documentation of any kind may be subject to prosecution, incarceration or deportation. All associated liability will be for the cost of the passenger concerned.
Payment and Cancellation
Payment is required within 24 hours of the confirmation of the passenger’s clearance to fly and a full 48 hours before the target departure timing when issued. Payment is strictly by electronic transfer only.
Cancellation by the passenger for any reason whatsoever within 48 hours of the flight departure, including failure to pass the mandatory pre-flight health screening, will incur a full 100% cancellation fee.
Please be advised that in case of no-show i.e. failure to travel without cancelling of flight booking well in advance of time/date of travel, there may be no refund due on the passenger air ticket, nor may any changes be allowed (rebooking of flights) for future travel on the same ticket.
Should there be any en-route changes or delays as a result of compliance with the requirements of international law or national legislation or subordinate legislation; the passenger or the passengers changed requirements, unserviceability of the aircraft beyond Absolute Flight Services’ reasonable control; safety of the aircraft; safety of the aircraft’s crew; and/or safety of the passenger/passengers, any additional costs arising from such changes and/or delays (excluding the costs of repairing the aircraft, but including the costs of arranging an alternative aircraft, transport, accommodation, food and beverages) shall become payable by the passenger in addition to the quoted price.
Any costs relating to quarantine requirements at destination are to be borne by the passenger including any Covid-19 testing, related travel and accommodation or food and beverages. Passengers are subject to variable Covid-19 related regulatory governance and demands at point of departure and at destination which may result in passenger detention and or incremental costs. Absolute Flight Services shall not be responsible to brief customers of regulatory standards and expectations nor any associated costs.
Travel insurance is strongly recommended for all travel and should be arranged by the passenger with its chosen insurer. We further advice passengers to direct any questions related to travel insurance to an accredited insurance broker. Absolute Flight Services is not authorised to advise the passenger on the terms of insurance and how they may apply to the passenger’s individual needs or circumstances.
Any insurance liabilities incurred for damages incurred by reason of theft, loading or offloading of baggage and the passenger’s items will be the passenger’s responsibility.
Absolute Flight Services is not in a position to provide any medical or related advice pertaining to the COVID-19 virus. Please direct medical questions to a healthcare professional and please consult reputable and up to date advisories regarding safety to travel to any particular destination and best practice precautions while travelling.
The onus is on the passenger to ensure compliance with any health requirements and recommended precautions relevant to travel, including but not limited to ensure that all necessary vaccination documentation is presented and any Covid-19 testing requirements are adhered to.
It is recommended that each passenger consult their local doctor, travel medical service or specialist vaccination clinic before commencing travel.
Smoking is prohibited on-board the flight.
Passenger baggage must not exceed 20 Kilograms (baggage hold) and no more than 5 Kilograms of hand luggage.
Dangerous goods are prohibited on-board the flight. In the interest of safety, Absolute Flight Services reserves the right to search all passengers and their luggage for any prohibited items. Copies of relevant dangerous goods regulations are available from Absolute Flight Services on request.
No pets will be allowed on-board the flight.
Liquids, aerosols, gels and powders
Strict regulations are in place with regards to the carrying of liquids, aerosol, gels and powders as hand luggage on international flights and is subject to the following:
The passenger may only carry liquids, aerosols and gels in the passenger’s hand luggage in containers that have a maximum capacity of 100 (one hundred) millilitres each;
The passenger may carry several containers with liquid contents however the total capacity may not exceed 1 (one) litre;
All 100 (one hundred) ml containers not exceeding one litre must be packed in a re-sealable, transparent plastic bag;
All inorganic powders must be in containers of 350 millimetres (volume), 350 grams (weight) or less. The total volume of inorganic powders may not exceed 350 millimetres or 350 grams. There is no limit on the number of containers however the total weight may not exceed 350 millimetres or 350 grams. It must be possible to open and re-seal the plastic bag and must be presented to security for inspection.
Passports are required for all passengers including infants for international travel. Passports and travel documents must comply with the following requirements:
- valid for at least 6 (six) months after the passenger’s date of return;
- must have a minimum 2 (two) blank pages;
- travel documents have to be in the name appearing on the Traveller’s passport.
- Temporary passports are not accepted in most countries.
- Most countries require machine-readable passports. It is the Passenger’s responsibility to ensure compliance.
- The Passenger indemnifies Absolute Flight Services against any errors which might occur and any cost relating thereto in the event that any Traveller’s passport has not been issued by the Department of Home Affairs at the date of completing the booking form.
- The onus is on permanent residents travelling on a foreign passport to ensure they have the required documentation to travel, including but not limited to visas.
- The onus is on the passenger, especially where the passenger has become a citizen of the relevant country by naturalisation, to ensure that they are travelling with the correct travel documents.
- Documentary identification is required for infants who are travelling.
- Travelling with Children: From 1 June 2015 all children under the age of 18 (eighteen) require the following:
- unabridged birth certificates to travel internationally in and out of South Africa;
- If travelling with one parent, consent in the form of an affidavit of the other parent is required as well as an unabridged birth certificate;
- If travelling with no parents, consent in the form of an affidavit is required from both parents as well as an unabridged birth certificate;
- Please refer to the Department of Home Affairs website for information on minors travelling internationally;
- Ages of children and infants travelling must relate to the dates of travel
The passenger hereby indemnify Absolute Flight Services from any claim or damage which the passenger may suffer from the flight, other than claims or damage caused by Absolute Flight Services’ own negligent or wilful misconduct.
Absolute Flight Services shall not be liable for any damages the passenger may suffer arising from compliance with the requirements of international law or national legislation or subordinate legislation; the passenger’s changed requirements; serviceability of the aircraft beyond Absolute Flight Services’ reasonable control; safety of the aircraft; safety of the aircraft’s crew; and/or safety of the passengers
Force Majeure and Delays
For the purpose of these Terms and Conditions, a force majeure event means circumstances beyond the reasonable control of Absolute Flight Services or any Supplier, affecting Absolute Flight Services’ ability to perform any of its obligations under these Terms and Conditions, including, but not necessarily be limited to, any of the following matters:
Strikes, terrorism, war, invasion, act of foreign enemy, hostilities or warlike operations (whether war be declared or not), civil war, mutiny, rebellion, revolution, insurrection, military or usurped power, epidemic outbreak, confiscation or destruction or requisition by order of any government or any public authority or any other Act of State, including prevention or denial of trade, sanctions or closure of borders;
Denial of the use or unavailability of any railway, port, airport, shipping service or other means of public transport, other than due to default on the part of Absolute Flight Services; and
Any other circumstances beyond the reasonable control and not within the reasonable expectation of Absolute Flight Services.
If Absolute Flight Services is prevented from or delayed in performing any of its obligations by circumstances beyond Absolute Flight Services or the Supplier’s control, then they will notify the Passenger in writing (insofar as it is aware thereof) of the nature and expected duration of such circumstances and of the obligation, performance of which is delayed or prevented.
Absolute Flight Services will, upon the occurring of the force majeure event, be excused from the performance or punctual performance, as the case may be, of its obligations, for so long as the circumstances or prevention or delay may continue.
In the event of any delay, deviation or diversion of any flight, including the occurrence of a Force Majeure event, the passenger shall be solely responsible for any and all accommodation, refreshments, meals, transportation or any other additional costs, expenses, losses, damages or liabilities of whatsoever nature incurred in respect of the passenger wherever and howsoever the same shall arise. All such costs, expenses, losses, damages or liabilities incurred by Absolute Flight Services shall be reimbursed by the passenger to Absolute Flight Services within 10 days of dated incurred.
In the event that Absolute Flight Services has to engage attorneys to enforce any of its rights in terms of these Terms and Conditions or otherwise, and in the event that Absolute Flight Services is successful in the enforcement of such rights, the client will be liable for all legal fees at an attorney and own client scale.
If any dispute arises between the Parties, the laws of South Africa will apply. The passenger irrevocably and unconditionally submit to the exclusive jurisdiction of the courts of South Africa, subject to section 70 of the Consumer Protection Act.
The rights and remedies conferred on the parties by this Agreement are cumulative and are not exclusive of any rights and remedies provided by law.
Sole record of agreement
These Terms and Conditions constitute the sole record of the agreement between the Parties with regard to the subject matter hereof. No Party shall be bound by any express or implied term, representation, warranty, promise or the like not recorded herein.
No relaxation or indulgence which any Absolute Flight Services may grant to the Customer shall constitute a waiver of the rights of Absolute Flight Services and shall not preclude that Absolute Flight Services from exercising any rights which may have arisen in the past or which might arise in future.
No party may assign or otherwise transfer any of its rights and/or obligations hereunder without the prior written consent of the other party.
If any provision of these Terms and Conditions shall be held illegal or unenforceable, such provision shall be deemed separate and divisible from and shall in no way affect or impair the validity or enforceability of, the remaining provisions.
The passenger acknowledge that he/she is 18 (eighteen) years of age or older and that he/she understand and have the legal capacity to enter into this contract and agree with the Terms and Conditions. The passenger’s decision to make travel arrangements through Absolute Flight Services is not based solely on the advice given by Absolute Flight Services and he/she hereby confirm that the travel arrangements were not made under duress.
